Who you are buying from

Vital Nimbus is a sole trader operated by Damian M. Bronzel, based in Basel, Switzerland. When you purchase from this site, the contract is between you and Damian M. Bronzel operating under the brand name Vital Nimbus.

Acceptance

By using the site, signing up for the worksheet, or buying a product, you agree to these Terms, our Privacy Policy, and our Refund and Returns Policy. If you do not agree, do not use the site.

What we sell

We sell digital products — currently The Science of Goal Setting, a downloadable PDF ebook. Other digital products may follow over time. The free Identity-First Goal Worksheet is delivered after email signup; it is not a paid product, but the same usage terms below apply to it.

All prices are shown in US dollars. Stripe converts to your local currency at checkout based on the prevailing exchange rate. Applicable taxes, where any apply, are added at checkout.

How a purchase works

You place an order through the site by selecting a product, entering your email and billing details, and submitting payment through Stripe or PayPal.

Your order is accepted when the payment processor confirms the charge succeeded. At that point you receive an order confirmation by email containing the download link or access instructions.

Delivery is electronic and is normally instant. If you have not received your file within ten minutes, check your spam folder, then contact us.

What you are allowed to do with the product

When you purchase a digital product from Vital Nimbus, you receive a single-user, non-exclusive, non-transferable, non-sublicensable licence to use the file for your own personal, non-commercial purposes.

You may:

• Download the file to your devices and read it as often as you like.

• Print one copy for your personal use.

• Quote brief excerpts for personal study, with attribution.

You may not:

• Resell, lease, lend, or redistribute the file to any third party.

• Upload the file to file-sharing platforms, torrent networks, free-download sites, or any public or semi-public location.

• Repackage the content into a derivative work — course, book, video, or otherwise — for distribution.

• Strip out, alter, or obscure any copyright, branding, or watermarking.

• Use the content to train, fine-tune, or otherwise feed any machine-learning system.

We retain all intellectual property rights in the product. The licence above is the only set of rights you receive. Breach of this licence terminates the licence immediately and may give rise to a claim for damages and injunctive relief.

Refunds

All sales are final on digital products. Because the product is delivered immediately and cannot be returned in any meaningful sense once accessed, we do not offer refunds for change of mind, dissatisfaction, or accidental purchase after the file has been delivered.

A small set of exceptions — duplicate charges, technical delivery failures we cannot resolve, or content that materially differs from the description — is set out in the Refund and Returns Policy. Any rights you have under EU, UK, US, or other consumer-protection law remain unaffected by anything in these Terms.

For EU and UK customers: by completing your purchase you expressly consent to immediate digital delivery and acknowledge that this waives the standard fourteen-day right of withdrawal under the EU Consumer Rights Directive and UK Consumer Contracts Regulations. If you wish to retain that right, do not download or access the file, and contact us within fourteen days of purchase to cancel.

Site content and intellectual property

All copy, design, images, logos, the V-mark, the Vital Nimbus wordmark, the worksheet, the ebook, blog posts, and any other content on the site are owned by Vital Nimbus or licensed to us. They are protected by copyright, trademark, and other applicable laws.

You may share short quotations and link to our pages with attribution. You may not republish substantial portions, scrape the site, mirror it, or use any content to build a competing product or service.

Disclaimer

The material on the site and in our products is provided for educational and informational purposes only. Vital Nimbus is not a licensed therapist, medical doctor, financial adviser, legal counsel, or coach in a regulated capacity. Nothing on the site constitutes medical, psychological, legal, financial, or any other form of professional advice.

Outcomes from applying our material vary and depend on factors outside our control. We make no guarantee of any specific result, transformation, or timeline. You are responsible for your own decisions and the consequences that follow from them.

Limitation of liability

To the maximum extent permitted by law:

• Vital Nimbus’s total cumulative liability to you for any claim arising out of or relating to the site, the products, or these Terms is limited to the amount you paid us in the twelve months preceding the claim, or fifty US dollars — whichever is greater.

• We are not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, loss of data, or loss of opportunity, even if we were advised of the possibility.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law in your jurisdiction — including liability for fraud, gross negligence, death, or personal injury caused by negligence.

Indemnification

You agree to indemnify and hold harmless Vital Nimbus and Damian M. Bronzel from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the products, or your violation of any third party’s rights or any law.

Governing law and jurisdiction

These Terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

Any dispute arising out of or relating to these Terms or the products is subject to the exclusive jurisdiction of the courts of Basel-Stadt, Switzerland, except that we may bring proceedings in any court of competent jurisdiction to enforce our intellectual property rights.

If you are a consumer resident in the EU, the UK, the US, or another jurisdiction whose law gives you mandatory rights that cannot be waived by contract, those mandatory rights apply alongside this clause.

DMCA / copyright complaints

If you believe content on the site infringes your copyright, send a notice to support@vitalnimbus.store containing: the work that has been infringed, the URL of the infringing material, your contact details, and a statement made under penalty of perjury that the information is accurate and that you are the owner or authorised agent. We respond to substantiated notices promptly.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top reflects the most recent change. Continued use of the site after a change means you accept the updated Terms. Material changes will be communicated by email to active subscribers.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and the Refund and Returns Policy, are the entire agreement between you and Vital Nimbus regarding the site and the products, and supersede any prior agreement.
